Our style of practice can be best described as "aggressive". In general, we find that a strong correlation exists between the degree of proactiveness in defense and the results obtained. Full development of both legal and equitable defenses has consistently resulted in an extremely high proportion of case resolution through summary dismissals, favorable jury verdicts and low settlements. The Litigation Department has handled every conceivable type of commercial lawsuit, from breach of contract to secured transactions to bankruptcy proceedings, including the following major areas:

* Representing both condemning authorities and condemnees in connection with the acquisition of property by public agencies for various public purposes;

* All aspects of construction litigation on behalf of owners, general contractors and trade contractors and involving bonds, liens, Miller Act and "Little Miller Act" claims, delay and acceleration claims, and claims of defective work;

* Negotiating and litigating with insurance companies to obtain coverage under comprehensive general liability, property, excess, and umbrella insurance policies to pay legal and technical expenses and environmental damages and clean-up costs for environmental clean-ups;

* Successfully representing companies and their ERISA plans in landmark ERISA preemption litigation;

* Handling the defense of products liability cases involving a wide variety of different products, including pharmaceuticals, natural gas connectors, beverage containers, motor vehicles, chemical processing machinery, boats, scaffolding, garage hoists, chemicals, motorized wheelchairs, hospital equipment, electric dryers, gas dryers, asbestos, overhead cranes, tow trucks, and bedliners;

* Appearing before both federal and state regulatory agencies;

* Handling numerous major cases in the securities and corporate area, including nationwide class actions and derivative lawsuits;

* Representing clients, including major brokerage and investment firms, in a variety of securities matters, including federal court litigation, regulatory investigations and proceedings, and in the arbitration of numerous customer claims as well as intra-industry disputes such as raiding and employment matters; and

* An active white collar criminal defense practice.
